Terms of Use

1. Our services

UVisaStatus.com provides a U visa wait-time calculator, explanatory news, practical guides and educational content, public comment features, and related website tools (collectively, the “Services”). The Services are operated from the United States and are intended for users who are at least 18 years old.

The calculator produces planning estimates from general USCIS data and the date you enter. It does not review your file, predict an individual decision, establish a place in line, or create any right or benefit. UVisaStatus.com is not USCIS, the Department of Homeland Security, a law firm, or your legal representative. Nothing on the Services is legal advice or a substitute for advice from a qualified immigration attorney or Department of Justice–accredited representative.

2. Intellectual property rights

Our intellectual property

Unless otherwise indicated, the Services and their source code, databases, functionality, software, website design, text, graphics, logos, and other original materials are owned by or licensed to us and are protected by applicable intellectual-property laws.

Your use of the Services

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access the Services and to print or download reasonable portions of the content for personal, non-commercial use. You may not reproduce, republish, sell, license, publicly display, scrape, or commercially exploit the Services without our prior written permission, except as allowed by law.

3. User representations

By using the Services, you represent that you have legal capacity to agree to these Terms; the information you submit is truthful to the best of your knowledge; you will not use the Services for an unlawful or unauthorized purpose; and your use will comply with applicable laws and regulations. If you are using the Services for an organization, you represent that you are authorized to bind that organization.

4. Prohibited activities

You may not use the Services to:

• break any law, violate another person’s rights, or facilitate fraud or deception;
• collect content or data through unauthorized scraping, crawling, bots, or similar tools;
• circumvent security, rate limits, access controls, or anti-abuse protections;
• upload malware, interfere with operation, overload systems, or probe for vulnerabilities;
• impersonate another person, misrepresent affiliation, or submit false abuse reports;
• harass, threaten, exploit, defame, or unlawfully discriminate against another person;
• post private immigration records, receipt numbers, addresses, or other sensitive data;
• copy or adapt the Services’ software except as expressly permitted by law; or
• use the Services to compete with us, advertise, solicit, or send spam without permission.

5. User-generated contributions

The Services may allow you to submit comments, reports, feedback, or other materials (“Contributions”). Contributions may be public and may be viewed or shared by others.

You are responsible for your Contributions. You represent that you own or have permission to use them; they are accurate enough not to mislead; and they do not infringe rights, reveal confidential or sensitive information, contain unlawful or abusive material, or violate these Terms. Do not post case-specific information that could identify you or another person. We may remove or edit Contributions, but we are not required to monitor every submission.

6. Contribution license

You retain ownership of your Contributions. When you post a public Contribution, you give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format, moderate, and distribute it only as reasonably necessary to operate, promote, and improve the Services. This license includes the display name you choose to publish.

For private feedback or suggestions, you allow us to use the ideas without restriction or compensation. You remain responsible for your Contributions and agree that they are not confidential unless we expressly agree otherwise in writing.

7. Third-party websites and content

The Services link to USCIS, news outlets, nonprofit organizations, social platforms, and other third parties. We do not control those sites and are not responsible for their content, availability, security, products, or privacy practices. A link does not necessarily mean we endorse every statement or service on the linked site. Your dealings with third parties are between you and them and are governed by their terms.

8. Advertisers

We do not currently display third-party advertising. If advertising is added, advertisers will be responsible for their advertisements, products, and claims, and we will update our disclosures as required. Advertising would not constitute immigration or legal advice.

9. Services management

We may monitor the Services for violations, remove or limit content, restrict access, preserve records, and take appropriate technical or legal action to protect users, our rights, and the proper operation of the Services. We may do so in our reasonable discretion, but these Terms do not require us to monitor all activity or Contributions.

10. Privacy policy

Our Privacy Policy explains how the Services handle calculator dates, comments, technical data, and privacy requests. By using the Services, you acknowledge that information may be processed in the United States and other countries where our service providers operate.

11. Copyright infringements

We respect intellectual-property rights. If you believe material on the Services infringes a copyright you own or control, email [email protected] with identification of the work and material, the page URL, your contact information, a statement of good-faith belief, and a statement that your notice is accurate and that you are authorized to act. Knowingly false notices may create liability.

12. Term and termination

These Terms remain in effect while you use the Services. We may suspend, restrict, or end access, remove content, or discontinue a feature if we reasonably believe you violated these Terms, created risk, or used the Services unlawfully. Provisions that by their nature should survive termination—including intellectual-property, contribution-license, disclaimer, liability, indemnification, and dispute provisions—will survive.

13. Modifications and interruptions

We may change, correct, update, suspend, or discontinue any part of the Services without notice. We do not guarantee that the Services or any specific content will always be available, current, or error-free. Maintenance, provider outages, policy changes, and events beyond our control may interrupt access. We are not liable for losses caused solely by an inability to access the Services.

14. Governing law

These Terms and your use of the Services are governed by the laws of the State of California, without regard to conflict-of-law rules, except to the extent federal law controls. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15. Dispute resolution

Informal negotiations

Before filing a formal claim, each party agrees to give the other written notice and try in good faith to resolve the dispute informally for at least 30 days. Send notices to [email protected].

Binding arbitration

If a dispute is not resolved informally, it will be finally resolved by individual, binding arbitration administered by the American Arbitration Association (“AAA”) under its then-current Consumer Arbitration Rules, except where applicable law does not permit arbitration. The Federal Arbitration Act governs this provision. The arbitration may be conducted by documents, phone, video, or in person as the rules permit. Unless the parties agree otherwise, any in-person hearing will occur in Santa Clara County, California, or another location required for a consumer claim. The arbitrator may award the same individual remedies available in court.

You and UVisaStatus.com waive the right to a jury trial and agree to bring claims only in an individual capacity, not as a plaintiff or class member in a class, collective, consolidated, or representative proceeding, to the fullest extent permitted by law.

Exceptions

Either party may bring an eligible claim in small claims court. Claims concerning the validity or enforcement of intellectual-property rights, theft, piracy, unauthorized use, privacy, or requests for temporary or injunctive relief may be brought in a court of competent jurisdiction. If arbitration is unavailable or a restriction above is unenforceable, the dispute may be heard in the state or federal courts located in Santa Clara County, California, and each party consents to jurisdiction there, unless applicable law requires another forum.

16. Corrections

The Services may contain typographical errors, omissions, outdated information, or inaccuracies, including in estimates and descriptions. We may correct or update content at any time without prior notice. You should verify important immigration information directly with USCIS or a qualified legal-services provider.

17. Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ANY IMMIGRATION OUTCOME, PROCESSING TIME, WORK PERMIT, VISA APPROVAL, GREEN CARD ELIGIBILITY, OR UNINTERRUPTED OPERATION. YOU USE THE SERVICES AND RELY ON THEIR CONTENT AT YOUR OWN RISK.

18. Limitations of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UVISASTATUS.COM AND ITS OPERATOR, SERVICE PROVIDERS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST DATA, LOST REVENUE, OR LOSSES RESULTING FROM RELIANCE ON AN ESTIMATE OR CONTENT, INCLUDING ANY DECISION, ACTION, OR INACTION BASED ON THAT INFORMATION. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US DURING THE SIX MONTHS BEFORE THE CLAIM OR $1,000. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS, SO THESE LIMITS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

19. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless UVisaStatus.com, its operator, service providers, and contributors from third-party claims, losses, liabilities, and reasonable expenses arising from your Contributions, misuse of the Services, violation of these Terms, or infringement of another person’s rights. We may control the defense of a covered matter, and you agree to cooperate reasonably.

20. User data

You are responsible for information you submit and for keeping your own copies. Although we use reasonable safeguards and may perform backups, we are not responsible for loss or corruption of Contributions or other data. The calculator is not a document-storage service; do not use it to store immigration records or sensitive personal information.

21. Electronic communications, transactions, and signatures

Visiting the Services, submitting a form, or emailing us constitutes electronic communication. You consent to receive notices and records electronically and agree that electronic communications satisfy legal requirements that they be in writing, subject to any non-waivable rights under applicable law. The Services do not currently sell products or require electronic signatures.

22. California users and residents

If a complaint is not resolved to your satisfaction, you may contact the California Department of Consumer Affairs, Consumer Information Center, 1625 North Market Blvd., Suite N-112, Sacramento, California 95834, by phone at (800) 952-5210, or through the Department’s consumer resources.

23. Miscellaneous

These Terms and the Privacy Policy are the entire agreement regarding the Services. Our failure to enforce a provision is not a waiver. If any provision is unlawful or unenforceable, it will be limited or severed to the minimum extent necessary and the rest will remain effective. We may assign these Terms; you may not assign them without our written consent. No agency, partnership, joint venture, employment, or franchise relationship is created. We may update these Terms by posting a revised date; continued use after the effective date means you accept the revised Terms.
